Expanding on my earlier theme of the upcoming civil war between the states and the federal government, comes this duo of news items:
In the red corner, the Attorney General for the state of Virginia, Ken Cuccinelli, has sent a letter to the state’s public colleges and universities asking them to rethink their policies that ban discrimination based on sexual orientation because those institutions of higher learning do not have the authority to implement such a policy. Only the state legislature can make such a policy, Cuccinelli asserts. (Link here)
And in the blue corner, Secretary of Education, Arne Duncan, is planning to ramp up enforcement of civil rights laws in schools and colleges. (Link here)
So one wants to de-scope equality protection given to one class of individuals and one wants to intensify the protection given by the law.
It’s not exactly the Medusa versus the Kraken, but I wonder, as is usually the case in these titanic clashes, how many regular citizens will be trampled.
